By accessing or using OptiVulnix services, you agree to be bound by these
Terms and Conditions. If you do not agree with these terms, you must not
use our services.

2. Services Description

OptiVulnix provides IT infrastructure automation and optimization services,
including intelligent detection, prediction, and automated resolution of
infrastructure issues across your technology stack.

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized account access
• Only one individual or entity may use an account unless otherwise agreed

4. Acceptable Use

You agree not to:

• Use our services for illegal or unauthorized activities
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt service availability or performance
• Upload malicious code, malware, or viruses
• Violate intellectual property or proprietary rights
• Reverse engineer, decompile, or attempt to extract source code

5. Service Level Agreements

Service levels, uptime guarantees, and response times are defined in your
Service Agreement. Infrastructure monitoring capabilities depend on your
selected subscription tier.

6. Data and Privacy

Your use of our services is governed by our Privacy Policy. You retain
ownership of your data and grant OptiVulnix a limited license to process
such data solely for service delivery and improvement purposes.

7. Payment Terms

• Fees are as specified in your service agreement
• Payments are due according to the selected billing cycle
• Late payments may result in service suspension or termination
• All fees are non-refundable unless explicitly stated otherwise

8. Intellectual Property

All software, content, automation algorithms, and technologies provided
by OptiVulnix remain our exclusive intellectual property. You are granted
a limited, non-exclusive, non-transferable license to use our services.

9. Termination

Either party may terminate services in accordance with the notice period
defined in the Service Agreement. We reserve the right to suspend or
terminate access immediately for violations of these terms.

10. Warranties and Disclaimers

Services are provided on an “as is” and “as available” basis without
warranties of any kind. We do not guarantee uninterrupted service or
complete prevention of infrastructure issues.

11. Limitation of Liability

To the maximum extent permitted by law, OptiVulnix’s total liability shall
not exceed the fees paid by you during the twelve (12) months preceding
the claim. We are not liable for indirect, consequential, or punitive
damages.

12. Confidentiality

Both parties agree to maintain the confidentiality of non-public
information exchanged during the course of the service relationship.

13. Changes to Terms

We may update these Terms and Conditions with at least 30 days’ notice.
Continued use of our services after changes constitutes acceptance.

14. Governing Law and Disputes

These terms are governed by the laws of the jurisdiction in which
OptiVulnix is registered. Disputes shall be resolved through arbitration
prior to litigation.

15. Force Majeure

We shall not be liable for failures or delays caused by events beyond
reasonable control, including natural disasters, cyber attacks, or
infrastructure outages.
